Privacy Policy

 

BACKGROUND

  1. ReviseOnline is the owner of the Website from which it offers course materials to students completing their year 11 and 12 high school exams.
  2. ReviseOnline agrees to grant the Member access to the Website subject to this Policy.
  3. The Member agrees to the use of the Website in accordance with this Policy.

Definitions

“Australian Privacy Principles” means the Australian Privacy Principles set out in the Privacy Act 1988;  

“Confidential Information” means information which relates directly or indirectly to the business, operations or affairs of the business of ReviseOnline and which ReviseOnline, acting reasonably, advises the Member it regards as confidential, whether the information is in oral, visual or written form or is recorded in any other medium and includes the Course Materials, all information contained on the Website, the existence of this Policy and Conditions and any other information whatsoever supplied by ReviseOnline to the Member and any other records, documents, plans, formulae, specifications, Intellectual Property, devices, methods, price information, and papers of every description including all copies or extracts from the same relating to the affairs or the business of ReviseOnline or any subsidiary of a party which from time to time is made available or becomes known or comes into the possession of the Member;

“Course Materials” means all reference materials, study guides and other information provided by ReviseOnline;

“Intellectual Property” means copyright, patents, trademarks, (registered or not), designs, design rights, trade secrets, logos including but not limited to all other proprietary technical information;

“Member” means a person who purchases a subscription to Course Materials on the Website 

“ReviseOnline” means ReviseOnline Pty Ltd ACN: 605 449 134; 

“Subscription Fee” means all fees and charges payable by a Member to ReviseOnline to access Course Materials; 

“Policy” means this Policy and conditions as supplemented, varied or amended from time to time; and

“Website” means www.atarprep.reviseonline.com 

1.       Privacy Statement

1.1 Introduction

The Privacy Act 1988 requires ReviseOnline to have procedures in place that cover the collection, use and disclosure of personal information that it receives from the Member. This information is needed to process the requirements of the Member and is used for internal purposes. Without this information, ReviseOnline is unable to provide access to the Website and the Course Materials to the Member. ReviseOnline complies with the Australian Privacy Principles in relation to the collection and disclosure of information regarding the Member.

1.2 What personal information about the Member is collected by ReviseOnline.

  1. Name; 
  2. Email addresses; 
  3. Information disclosed by the Member to ReviseOnline;
  4. Details of Course Materials provided to the Member; and
  5. Information disclosed in emails or online contact with Member.

1.3 This Privacy Statement applies to any personal information provided to ReviseOnline:

  1. when visiting the Website or Course Materials;
  2. when entering into an agreement with ReviseOnline and/or another third party;
  3. when the Member requests ReviseOnline forward information about them to a third party;
  4. when the Member corresponds or communicates with ReviseOnline over the telephone or in any other manner including by letter, facsimile or email.

In addition to collecting personal information directly from the Member, ReviseOnline may also obtain personal information about the Member from third party sources such as its training providers and other third party service providers.

1.4    Types of information Collected

ReviseOnline gathers two types of information about Members, namely:

  1. aggregated information generated by its systems (or third party systems) to track the Website’s traffic but that does not identify the Member personally including: 

(i)       information to track data such as the total number of visits to the Website and the number of visits to specific areas of the Website; 

(ii)      the domain names of the Website visitors' internet service providers; and 

      b. cookies' and 'applets' in its website systems. 

      c. personal information about the Member such as name, email address, website usage  and in some cases, billing details and general financial and credit information.

 

The type of information that ReviseOnline collects about the Member is dependent on how the Member uses the services offered on the Website and the Course Materials the Member purchased through ReviseOnline.

Generally, ReviseOnline does not collect 'sensitive information' about its Members. Sensitive information includes (but is not limited to) information about race or ethnic origin, religion and sexual preferences. ReviseOnline will only collect sensitive information in the event that it is necessary for the purpose of providing the Member with a product or service. In such circumstances, ReviseOnline will only collect sensitive information with a Member’s consent unless it is required by law to collect such information.

1.5    How ReviseOnline uses the Member’s personal information

ReviseOnline may use the Member’s personal information for one or more of the following purposes:

  1. inform the Member of other products, services or offerings available from ReviseOnline or its affiliates, including related entities and business associates, including any marketing material; 
  2. conduct surveys or research about the Member’s opinion of current services and products or of potential new services and products that may be offered; 
  3. contact the Member regarding a product offered by an external business partner which may be of interest to the Member; and 
  4. provide to likely or actual buyers of the whole or part of ReviseOnline’s business or for internal restructuring purposes.

1.6. Disclosure of personal information to third parties

  1. ReviseOnline may disclose the Member’s personal information to its training providers in order to facilitate the Member’s enrolment in a selected course.
  2. ReviseOnline may also disclose the Member’s personal information to third party contractors who perform services for it including the management and maintenance of its information systems.
  3. Where the Member’s personal information is passed on to third party contractors, ReviseOnline takes reasonable steps to ensure that these individuals and/or organisations are bound by confidentiality and privacy obligations in relation to the protection of the Member’s personal information.
  4. Other than as outlined above, ReviseOnline will not disclose the Member’s personal information without their consent unless disclosure is necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.

 1.7 Access to and correction of information ReviseOnline holds

  1. Upon a Member’s request, ReviseOnline will provide them with access to their personal information unless there is an exception which applies under the Australian Privacy Principles. If ReviseOnline denies such access, the Member will be told why.
  2. ReviseOnline may recover any reasonable costs incurred in providing the Member with access to the requested information. To request access to personal information, please contact ReviseOnline using one of the contact options provided on the Website.
  3. If a Member is a ReviseOnline Registered user, they can access their registered profile at any time.

1.8 Keeping information up to date

ReviseOnline strives to ensure that the information we hold about our Members is accurate, complete and up to date at all times. If the personal information ReviseOnline holds about a Member is inaccurate, incomplete, or no longer up to date, or the Member wishes for their details to be removed from the Website, please contact us at [email protected]  so that reasonable steps can be taken to address this and/or discuss alternative options with the Member. 

1.9 Storage and security of the Member’s personal information (Data Sovereignty) 

ReviseOnline takes reasonable steps to protect the security of the Member’s personal information in accordance with this Privacy Statement. Unfortunately, no data transmission over the internet can be guaranteed to be totally secure. Whilst ReviseOnline strives to protect such information, it cannot ensure or provide any warranties in respect of the security of any information the Member provides to it or obtains from the Website. Accordingly, use of the Website is at the Member’s own risk. Once any personal information comes into ReviseOnline’s possession, it will take reasonable steps to protect that information from misuse and loss and from unauthorised access, modification or disclosure.

All storage and the security of information held by ReviseOnline is the responsibility of Amazon Web Services managed by access to Thinkific LMS. 

1.10 Links to other websites

The ReviseOnline website contains links to other websites. Please note that these links are intended for the Member’s convenience only. Links to third party websites do not constitute endorsement, sponsorship or approval by ReviseOnline of the content, policies or practices of those third party websites. If a Member has any concerns regarding their privacy when visiting a linked third party, they should ensure that they check the privacy statement/policies of those websites.

1.11  Destruction of the Member’s personal information

ReviseOnline will take reasonable steps to destroy or de-identify any personal information about the Member once the information is no longer required for the purposes for which it was collected or as authorised or required by law.

1.12  Changes to ReviseOnline's Privacy Statement

  1. From time to time, ReviseOnline may make changes to this Privacy Statement. Accordingly, the Member should periodically review this statement to remain informed about how ReviseOnline collects and protects personal information.
  2. The Member’s continued use of the ReviseOnline website constitutes acceptance of the collection, use and disclosure of personal information to the extent outlined in this Privacy Statement as amended from time to time.
  3. For further information about the protection of a Member’s privacy, please visit the Australian Federal Privacy Commissioner's website at www.privacy.gov.au.

1.13 Feedback and questions about privacy and the ReviseOnline website

  1. ReviseOnline welcomes ideas and feedback about all aspects of the ReviseOnline website. This feedback may be used to administer and refine the services provides and may be shared with ReviseOnline partners either in aggregate form or with specific identifying characteristics removed.

2. General

  1. If any part of this Policy is held invalid, illegal or unenforceable, that part shall be severed and the remainder will continue to be valid and enforceable. None of this Policy will merge in or upon the execution of this or any other agreement, document, act, matter or thing and will continue to remain in full force and effect for so long as is necessary to give effect to this Policy.
  2. ReviseOnline may vary this Policy at any time. In the event that ReviseOnline varies this Policy, it will provide notice by publishing the varied Policy on the Website. By doing this, ReviseOnline has provided the Member with sufficient notice of the variation.
  3. The use of the Website is governed by, construed and enforced in accordance with the laws of Western Australia, Australia and the user irrevocably submits to the jurisdiction of the courts of Western Australia, Australia and their respective courts of appeal in that regard.
  4. The Member may not assign this Policy or any of its rights and obligations in whole or in part in this Policy, whether by actual assignment or by operation of law or by providing any information on the Website to any third party without ReviseOnline’s prior written consent, unless otherwise agreed to in writing between the parties.
  5. A provision of this Policy may not be waived except in writing and signed by an authorised officer of ReviseOnline. No waiver or breach of any provision of this Policy shall constitute a waiver or breach of any other provision.
  6. If this Policy are inconsistent with any other previous document or agreement between the parties, this Policy will prevail to the extent of the inconsistency.
